Kiwi Technologies, Inc. dba as Guardian Agriculture (“company”, “we”, “us”,”our”) needs to gather and use information about individuals and businesses. This may include information collected from customers, business contacts, suppliers, employees, and others with whom the organization has had or will have a relationship. This policy describes how personal and commercial data is collected, handled, and stored to meet the company’s data protection standards, safeguard the privacy of individuals, protect sensitive data, and ensure compliance with the law.
This privacy notice applies to all information collected through our crop protection products, services, and supporting technologies, which includes our mobile applications (the “App”), collectively referenced as Services (the “Services”), as well as any related services, sales, marketing or events.
In this policy, “user” or “you” means any person viewing or using the Kiwi Technologies website (the “Site”), subscribing to or using the Services, or submitting any personal or business information to us in connection with the Services. By visiting the Site or using the Services, you indicate your consent to this Privacy Policy. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD NOT USE THE SITE OR SERVICES.
Policy brief & purpose
Our Data Protection and Privacy Policy refers to our commitment to treat information of employees, customers, stakeholders and other interested parties with the utmost care and confidentiality. With this policy, we ensure that we gather, store and handle data fairly, transparently and with respect towards individual rights.

Policy elements
As part of our operations, we need to obtain and process information. This information may include offline or online data that makes a person identifiable (“Personal Information”) such as names, addresses, usernames and passwords, digital footprints, photographs, social security numbers, financial data etc. Other data collected includes geographic location of our equipment, general customer data, billing data, operations data, performance data, crop data, product data, multiple types of media of our systems in operation, and other associated information necessary for performing, or improving our ability to perform, the Services (“Business Information”).
Our company collects this information in a transparent way and only with the full cooperation of interested parties. Once this information is available to us, the following rules apply.

Data access guidelines
Data will only be accessed by those who require access to it to do their jobs.

The only people able to access data covered by this policy should be those who need it for their work.

Data storage and security
We endeavor to secure our data, and have implemented appropriate technical and organizational security measures designed to protect the security of any Personal or Business Information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. BY USING OUR SERVICES, YOUR ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ASSUME THIS RISK.
These general guidelines apply to our data, including data that is usually stored electronically but has been printed out for some reason:

When not required, the paper or files should be kept in a locked drawer or filing cabinet.

Employees should make sure paper and printouts are not left where unauthorized people could see them, like on a printer.

If data is stored on removable media (like a CD or DVD), these should be kept locked away securely when not being used.

Data should only be stored on designated drives and servers, and should only be uploaded to an approved cloud computing services.

Servers containing customer data should be sited in a secure location, away from general office space.

Data should be backed up frequently. Those backups should be tested regularly, in line with the company’s standard backup procedures.

Data should not be saved directly to laptops or other mobile devices like tablets or smart phones except on a temporary basis as necessary to perform our jobs.

All servers and computers containing data should be protected by approved security software and a firewall.

Except where otherwise necessary, when data is transmitted through the Service, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.
Data usage
We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent. Data will be used only for the purposes of operating the business, performing our work, and improving our ability to do both of the former items.
What Information Do We Collect?
Site: If you contact Kiwi Technologies through the Site or sign up for our Services, we ask you for certain Personal and Business Information. If you contact us through the Site to inquire about career opportunities, we ask you for information such as your first and last name and email address. If you disclose additional Personal and Business Information to us, we may store that Personal and Business Information.
Web tracking information: We, and third party service providers that we engage to provide services to us (“Contractors”), may use web tracking technologies such as cookies, web beacons, pixel tags and clear GIFs in order to operate the Site efficiently and to collect data related to usage of the Services. Such collected data (“Web Tracking Information”) may include the address of the websites you visited before and after you visited the Kiwi Technologies Site, the type of browser you are using, your Internet Protocol (IP) address, what pages in the Site you visit and what links you clicked on, and whether you opened email communications we send to you. In order to collect Web Tracking Information and to make your use of the Site more efficient, we may store cookies on your computer. We may also use web tracking technologies that are placed in web pages on the Site or in email communications to collect information about actions that users take when they interact with the Services or such email communications, and our Contractors may also do so. We do not correlate Web Tracking Information to individual user Personal Information. Some Web Tracking Information may include data, such as IP address data, that is unique to you. You may be able to modify your browser settings to alter which web tracking technologies are permitted when you use the Services, but this may affect the performance of the Services.
Services: If you use the Services, we ask you for additional Personal and Business Information. The requested information depends on the specific Services to which you request. This information may include your work e-mail address, phone number, physical address, billing information, and job title, for subscribers. We may also request information related to your property and activities, such as GPS location information, and latitude and longitude coordinates, crop types serviced, products requested and or used, and other associated information necessary for performing, or improving our ability to perform, the Services.
Mobile users: If you access the App or the Site from a mobile device, we may collect unique identification numbers associated with your device, your geographic location data including GPS coordinates, or similar information regarding the location of your mobile device.
We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent. Data will be used only for the purposes of operating the business, performing our work, and improving our ability to do both of the former items.
We use the information we collect or receive:

If you choose to link your account with us to a third-party account (such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract.

To manage accounts. We may use your information for the purposes of managing your account and keeping it in working order.

Fulfill and manage Service delivery and or orders. We use your information to fulfill and manage your orders, payments, comments, reporting, and other associated tasks.

To respond to user inquiries/offer support. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our goods and or services

To improve the quality of our service. We may use data gathered in the course of our operations to improve the quality of our service.

How can you opt out of use and disclosure of your information?
If you wish to be removed from our mailing list, please contact us at privacy@guardian.ag. In the event of any such removal, Kiwi Technologies may retain copies of information for its archives. If you wish to opt out of promotional emails, you may do so by following the “unsubscribe” instructions in the email, or by editing your account settings, or by sending a request to privacy@guardian.ag. All users receive administrative emails, and so you cannot opt out of them while you remain an active user of the Services. Unless otherwise requested by the individual whose Personal Information is in the possession of Kiwi Technologies, Kiwi Technologies will retain Personal Information of users after the termination of the applicable Services for archival purposes.
Access and Updating of Information
You may be able to update some Personal Information by using tools on the Services. Kiwi Technologies will respond to any reasonable request by a user to review or amend his or her Personal Information held in our mailing list or database. Kiwi Technologies reserves the right to verify your identity in order to provide such access. Please contact us by sending an email to privacy@guardian.ag.
Links: The Site and Services may contain links to other websites. Kiwi Technologies is not responsible for the privacy practices or the content of those websites. Users should be aware of this when they leave our Site and review the privacy statements of each website they visit that collects information. This Privacy Policy applies solely to Personal and Business Information collected by Kiwi Technologies.
Amendments: Kiwi Technologies may modify or amend this policy from time to time. If we make any material changes, as determined by Kiwi Technologies, in the way in which Personal and Business Information is collected, used or transferred, we will notify you of these changes by modification of this Privacy Policy, which will be available for review by you on the Site.
Service visitors and users from outside the United States: Kiwi Technologies and its servers are located in the United States and are subject to the applicable state and federal laws of the United States. If you choose to access the Services, you consent to the use and disclosure of information in accordance with this privacy policy and subject to such laws.
California Online Privacy Protection Act Notice
On September 27, 2013, California enacted A.B. 370, amending the California Online Privacy Protection Act to require website operators like us to disclose how we respond to "Do Not Track Signals"; and whether third parties collect personally identifiable information about users when they visit us.
(1) We do not track users who do not interact with our sharing functionality across the web, and therefore do not use "do not track" signals.
(2) We do not authorize the collection of personally identifiable information from our users for third party use through advertising technologies without separate member consent.
California Civil Code Section 1798.83 also permits our users who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to privacy@gaurdian.ag. Please note that we are only required to respond to one request per user each year.
Children: Kiwi Technologies does not knowingly collect or maintain Personal Information from persons under 13 years of age, and no part of the Services are directed at persons under 18. If you are under 18 years of age, then please do not use the Services. If Kiwi Technologies learns that Personal Information of persons less than 13 years of age has been collected without verifiable parental consent, then Kiwi Technologies will take the appropriate steps to delete this information.
